Privacy policy

Information on the processing of your personal data pursuant to Art. 13 GDPR.

This page is a translation and is provided for information only. Only the German version is legally binding. German version

1. Controller

The controller responsible for the processing of personal data on this website is:

MD-AutoSales e.U.
Handelskai 265, 1020 Wien
Phone: +43 676 775 43 34
E-mail: info@autowien.net

We process your data exclusively on the basis of the statutory provisions, in particular the General Data Protection Regulation (GDPR), the Austrian Data Protection Act (Datenschutzgesetz, DSG) and the Austrian Telecommunications Act 2021 (Telekommunikationsgesetz 2021, TKG 2021).

2. Visiting the website and server log files

When you visit our website, our web hosting provider automatically processes data transmitted by your browser: IP address, date and time of access, the page visited, browser and operating system as well as the previously visited page (referrer).

This data is technically necessary in order to display the website and to ensure its security. The legal basis is our legitimate interest in secure and functioning operation (Art. 6(1)(f) GDPR). The log files are deleted automatically after a short period, unless they are required to investigate a security incident.

Our website is hosted by ALL-INKL.COM – Neue Medien Münnich, owner René Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany. The host processes the data exclusively on our behalf and in accordance with our instructions on servers in Germany; a data processing agreement pursuant to Art. 28 GDPR has been concluded with the host. The e-mails sent via the enquiry form are likewise routed through this host's servers.

3. Cookies and fonts

Our website does not set any cookies for analysis or advertising purposes and does not use any tracking services. The font we use is stored directly on our own server – no connection to third-party servers (e.g. Google) is established when the page is loaded.

4. Visitor statistics (Matomo)

In order to understand which pages are being read and whether visitors are using a mobile phone or a computer, we use the statistics software Matomo. Matomo runs on our own web space – no data is transferred to third parties.

No cookies are set in the process. Your IP address is truncated before it is stored, so that no conclusions can be drawn about you personally. The page visited, the date and time, the previously visited page, the type of device, the browser and the approximate region are recorded.

The legal basis is our legitimate interest in designing our website to meet our users' needs (Art. 6(1)(f) GDPR). If the “Do Not Track” function is activated in your browser, your visit is not counted.

5. Contact by telephone and e-mail

If you call us or send us an e-mail, we process the details you provide (e.g. name, telephone number, e-mail address, the content of your message) in order to answer your enquiry. The legal basis is the performance of pre-contractual measures or of a contract (Art. 6(1)(b) GDPR) as well as our legitimate interest in answering enquiries (Art. 6(1)(f) GDPR).

6. Finance calculator and finance enquiry

The finance calculator carries out all calculations exclusively in your browser; the values you enter are only transmitted once you send an enquiry.

When you submit the enquiry form, we process your first name, surname, e-mail address, telephone number, optionally the vehicle and your message, as well as the values from the calculator (loan amount, down payment, term, final instalment, monthly instalment). We use this data in order to deal with your enquiry and to contact you. You will receive an automatic acknowledgement of receipt at the e-mail address you have provided.

If you would like financing, we transmit the necessary data to the respective financing partner (bank or leasing company), which examines your enquiry and your creditworthiness. The financing partner's own privacy policy applies to any further processing carried out by that partner. The legal basis is the performance of pre-contractual measures at your request (Art. 6(1)(b) GDPR).

E-mail address check: So that we can reach you reliably, our server checks while you are filling in the form whether the e-mail address is spelled correctly, whether it is a known disposable address and whether the domain is able to receive e-mails. For this purpose only the domain part of the address (e.g. “gmx.at”) is queried via the public Domain Name System (DNS). Your full address is not passed on to third parties in the process.

Protection against misuse: To protect against spam we do not use any third-party services (no Google reCAPTCHA). Instead, we store an encrypted (hashed) value of your IP address for a maximum of one hour in order to limit the number of enquiries. The legal basis is our legitimate interest in preventing misuse (Art. 6(1)(f) GDPR).

7. Links to other websites

The “Our cars” links take you to our dealer profile on AutoScout24. In doing so you leave our website; the operator of AutoScout24 is responsible for the data processing carried out there. The privacy policy published there applies. As long as you do not click on the link, no data is transferred to AutoScout24.

8. Retention period

We store your data only for as long as is necessary for the respective purpose. Enquiries that do not lead to a transaction are deleted after 12 months at the latest. If a purchase or finance agreement is concluded, we retain the documents for 7 years on the basis of statutory obligations (in particular § 132 of the Austrian Federal Fiscal Code (Bundesabgabenordnung) and § 212 of the Austrian Commercial Code (Unternehmensgesetzbuch)), and beyond that only for as long as is necessary to defend against or assert legal claims.

9. Your rights

In principle you have the following rights:

  • Access to the data stored about you (Art. 15 GDPR)
  • Rectification of inaccurate data (Art. 16 GDPR)
  • Erasure (Art. 17 GDPR)
  • Restriction of processing (Art. 18 GDPR)
  • Data portability (Art. 20 GDPR)
  • Objection to processing based on legitimate interests (Art. 21 GDPR)
  • Withdrawal of consent you have given, with effect for the future (Art. 7(3) GDPR)

Simply contact us by e-mail at info@autowien.net.

10. Right to lodge a complaint

If you consider that the processing of your data infringes data protection law, you may lodge a complaint with the supervisory authority. In Austria this is:

Österreichische Datenschutzbehörde (Austrian Data Protection Authority)
Barichgasse 40–42, 1030 Wien
Phone: +43 1 52 152-0
E-mail: dsb@dsb.gv.at

11. Data security

Our website is transmitted via an encrypted connection (HTTPS/SSL). You can recognise this by the padlock symbol in the address bar of your browser.
